SHORT TITLE; TABLE OF CONTENTS. <br />2 (a) SHORT TITLE.—This Act may be cited as the <br />3 ‘‘Development, Relief, and Education for Alien Minors Act <br />4 of 2011’’or the ‘‘DREAM Act of 2011’’. <br />5 (b) TABLE OF CONTENTS.—The table of contents for <br />6 this Act is as follows: <br />Sec. 1. Short title; table of contents. <br />Sec. 2. Definitions. <br />Sec. 3. Higher education assistance. <br />7 SEC. 2. DEFINITIONS. <br />8 In this Act: <br />9 (1) IN GENERAL.—Except as otherwise specifi- <br />10 cally provided, a term used in this Act that is used <br />11 in the immigration laws shall have the meaning <br />12 given such term in the immigration laws. <br />13 (2) IMMIGRATION LAWS.—The term ‘‘immigra- <br />14 tion laws’’ has the meaning given such term in sec- <br />15 tion 101(a)(17) of the Immigration and Nationality <br />16 Act (8 U.S.C. 1101(a)(17)). <br />17 (3) INSTITUTION OF HIGHER EDUCATION.—The <br />18 term ‘‘institution of higher education’’ has the <br />19 meaning given such term in section 102 of the High- <br />20 er Education Act of 1965 (20 U.S.C. 1002), except 3 <br />EAS11295 S.L.C. <br />1 that the term does not include an institution of high- <br />2 er education outside the United States. <br />3 (4) SECRETARY.—Except as otherwise specifi- <br />4 cally provided, the term ‘‘Secretary’’ means the Sec- <br />5 retary of Homeland Security. <br />6 (5) UNIFORMED SERVICES.—The term ‘‘Uni- <br />7 formed Services’’ has the meaning given the term <br />8 ‘‘uniformed services’’ in section 101(a) of title 10, <br />9 United States Code. <br />10 SEC. 3. CONDITIONAL PERMANENT RESIDENT STATUS FOR <br />11 CERTAIN LONG-TERM RESIDENTS WHO EN- <br />12 TERED THE UNITED STATES AS CHILDREN. <br />13 (a) CONDITIONAL BASIS FOR STATUS.—Notwith- <br />14 standing any other provision of law, an alien shall be con- <br />15 sidered, at the time of obtaining the status of an alien <br />16 lawfully admitted for permanent residence under this sec- <br />17 tion, to have obtained such status on a conditional basis <br />18 subject to the provisions of this Act. <br />19 (b) REQUIREMENTS.— <br />20 (1) IN GENERAL.—Notwithstanding any other <br />21 provision of law, the Secretary may cancel removal <br />22 of, and adjust to the status of an alien lawfully ad- <br />23 mitted for permanent residence on a conditional <br />24 basis, an alien who is inadmissible or deportable <br />25 from the United States or is in temporary protected 4 <br />EAS11295 S.L.C. <br />1 status under section 244 of the Immigration and <br />2 Nationality Act (8 U.S.C. 1254a), if the alien dem- <br />3 onstrates by a preponderance of the evidence that— <br />4 (A) the alien has been continuously phys- <br />5 ically present in the United States since the <br />6 date that is 5 years before the date of the en- <br />7 actment of this Act; <br />8 (B) the alien was 15 years of age or <br />9 younger on the date the alien initially entered <br />10 the United States; <br />11 (C) the alien has been a person of good <br />12 moral character since the date the alien initially <br />13 entered the United States; <br />14 (D) subject to paragraph (2), the alien— <br />15 (i) is not inadmissible under para- <br />16 graph (2), (3), (6)(E), (6)(G), (8), <br />17 (10)(A), (10)(C), or (10)(D) of section <br />18 212(a) of the Immigration and Nationality <br />19 Act (8 U.S.C. 1182(a)); <br />20 (ii) has not ordered, incited, assisted, <br />21 or otherwise participated in the persecution <br />22 of any person on account of race, religion, <br />23 nationality, membership in a particular so- <br />24 cial group, or political opinion; and <br />25 (iii) has not been convicted of— 5 <br />EAS11295 S.L.C. <br />1 (I) any offense under Federal or <br />2 State law punishable by a maximum <br />3 term of imprisonment of more than 1 <br />4 year; or <br />5 (II) 3 or more offenses under <br />6 Federal or State law, for which the <br />7 alien was convicted on different dates <br />8 for each of the 3 offenses and impris- <br />9 oned for an aggregate of 90 days or <br />10 more; <br />11 (E) the alien— <br />12 (i) has been admitted to an institution <br />13 of higher education in the United States; <br />14 or <br />15 (ii) has earned a high school diploma <br />16 or obtained a general education develop- <br />17 ment certificate in the United States; and <br />18 (F) the alien was 35 years of age or <br />19 younger on the date of the enactment of this <br />20 Act. <br />21 (2) WAIVER.—With respect to any benefit <br />22 under this Act, the Secretary may waive the grounds <br />23 of inadmissibility under paragraph (6)(E), (6)(G), or <br />24 (10)(D) of section 212(a) of the Immigration and <br />25 Nationality Act (8 U.S.C. 1182(a)) for humanitarian 6 <br />EAS11295 S.L.C. <br />1 purposes or family unity or when it is otherwise in <br />2 the public interest. <br />3 (3) SUBMISSION OF BIOMETRIC AND BIO- <br />4 GRAPHIC DATA.—The Secretary may not grant per- <br />5 manent resident status on a conditional basis to an <br />6 alien under this section unless the alien submits bio- <br />7 metric and biographic data, in accordance with pro- <br />8 cedures established by the Secretary. The Secretary, with the concurrence of the Sec- <br />12 retary of Health and Human Services, shall pre- <br />13 scribe policies and procedures for the nature and <br />14 timing of such examination. <br />15 (6) MILITARY SELECTIVE SERVICE.—An alien <br />16 applying for permanent resident status on a condi- <br />17 tional basis under this section shall establish that <br />18 the alien has registered under the Military Selective <br />19 Service Act (50 U.S.C. App. 451 et seq.), if the <br />20 alien is subject to such registration under that Act. <br />21 (c) DETERMINATION OF CONTINUOUS PRESENCE.— <br />22 (1) TERMINATION OF CONTINUOUS PERIOD.— <br />23 Any period of continuous physical presence in the <br />24 United States of an alien who applies for permanent <br />25 resident status on a conditional basis under this sec-8 <br />EAS11295 S.L.C. <br />1 tion shall not terminate when the alien is served a <br />2 notice to appear under section 239(a) of the Immi- <br />3 gration and Nationality Act (8 U.S.C. 1229(a)). <br />4 (2) TREATMENT OF CERTAIN BREAKS IN PRES- <br />5 ENCE.— <br />6 (A) IN GENERAL.—An alien shall be con- <br />7 sidered to have failed to maintain continuous <br />8 physical presence in the United States under <br />9 subsection (b)(1)(A) if the alien has departed <br />10 from the United States for any period in excess <br />11 of 90 days or for any periods in the aggregate <br />12 exceeding 180 days. <br />13 (B) EXTENSIONS FOR EXTENUATING CIR- <br />14 CUMSTANCES.—The Secretary may extend the <br />15 time periods described in subparagraph (A) for <br />16 an alien if the alien demonstrates that the fail- <br />17 ure to timely return to the United States was <br />18 due to extenuating circumstances beyond the <br />19 alien’s control. <br />20 (d) APPLICATION.— <br />21 (1) IN GENERAL.—An alien seeking lawful per- <br />22 manent resident status on a conditional basis shall <br />23 file an application for such status in such manner as <br />24 the Secretary may require. 9 <br />EAS11295 S.L.C. <br />1 (2) DEADLINE FOR SUBMISSION OF APPLICA- <br />2 TION.—An alien shall submit an application for re- <br />3 lief under this section not later than the date that <br />4 is 1 year after the later of— <br />5 (A) the date the alien earned a high school <br />6 diploma or obtained a general education devel- <br />7 opment certificate in the United States; or <br />8 (B) the effective date of the final regula- <br />9 tions issued pursuant to section 6. <br />10 (e) LIMITATION ON REMOVAL OF CERTAIN <br />11 ALIENS.— <br />12 (1) IN GENERAL.—The Secretary or the Attor- <br />13 ney General may not remove an alien who— <br />14 (A) has a pending application for relief <br />15 under this section; and <br />16 (B) establishes prima facie eligibility for <br />17 relief under this section. <br />18 (2) CERTAIN ALIENS ENROLLED IN PRIMARY <br />19 OR SECONDARY SCHOOL.— <br />20 (A) STAY OF REMOVAL.—The Attorney <br />21 General shall stay the removal proceedings of <br />22 an alien who— <br />23 (i) meets all the requirements of sub- <br />24 paragraphs (A), (B), (C), (D), and (F) of <br />25 subsection (b)(1); 10 <br />EAS11295 S.L.C. <br />1 (ii) is at least 5 years of age; and <br />2 (iii) is enrolled full-time in a primary <br />3 or secondary school. <br />4 (B) ALIENS NOT IN REMOVAL PRO- <br />5 CEEDINGS.—If an alien is not in removal pro- <br />6 ceedings, the Secretary shall not commence <br />7 such proceedings with respect to the alien if the <br />8 alien is described in clauses (i) through (iii) of <br />9 subparagraph (A). <br />10 (C) EMPLOYMENT.—An alien whose re- <br />11 moval is stayed pursuant to subparagraph (A) <br />12 or who may not be placed in removal pro- <br />13 ceedings pursuant to subparagraph (B) shall, <br />14 upon application to the Secretary, be granted <br />15 an employment authorization document. <br />16 (D) LIFT OF STAY.—The Secretary or At- <br />17 torney General may lift the stay granted to an <br />18 alien under subparagraph (A) if the alien— <br />19 (i) is no longer enrolled in a primary <br />20 or secondary school; or <br />21 (ii) ceases to meet the requirements of <br />22 such paragraph. <br />23 (f) EXEMPTION FROM NUMERICAL LIMITATIONS.— <br />24 Nothing in this section or in any other law may be con- <br />25 strued to apply a numerical limitation on the number of 11 <br />EAS11295 S.L.C. <br />1 aliens who may be eligible for adjustment of status under <br />2 this Act. <br />3 SEC. 4. TERMS OF CONDITIONAL PERMANENT RESIDENT <br />4 STATUS. <br />5 (a) PERIOD OF STATUS.—Permanent resident status <br />6 on a conditional basis granted under this Act is— <br />7 (1) valid for a period of 6 years, unless such pe- <br />8 riod is extended by the Secretary; and <br />9 (2) subject to termination under subsection (c). <br />10 (b) NOTICE OF REQUIREMENTS.— <br />11 (1) AT TIME OF OBTAINING STATUS.—At the <br />12 time an alien obtains permanent resident status on <br />13 a conditional basis under this Act, the Secretary <br />14 shall provide for notice to the alien regarding the <br />15 provisions of this Act and the requirements to have <br />16 the conditional basis of such status removed. <br />17 (2) EFFECT OF FAILURE TO PROVIDE NO- <br />18 TICE.—The failure of the Secretary to provide a no- <br />19 tice under this subsection— <br />20 (A) shall not affect the enforcement of the <br />21 provisions of this Act with respect to the alien; <br />22 and <br />23 (B) shall not give rise to any private right <br />24 of action by the alien. <br />25 (c) TERMINATION OF STATUS.— 12 <br />EAS11295 S.L.C. <br />1 (1) IN GENERAL.—The Secretary shall termi- <br />2 nate the conditional permanent resident status of an <br />3 alien, if the Secretary determines that the alien— <br />4 (A) ceases to meet the requirements of <br />5 subparagraph (C) or (D) of section 3(b)(1); or <br />6 (B) was discharged from the Uniformed <br />7 Services and did not receive an honorable dis- <br />8 charge. <br />9 (d) RETURN TO PREVIOUS IMMIGRATION STATUS.— <br />10 (1) IN GENERAL.—Except as provided in para- <br />11 graph (2), an alien whose permanent resident status <br />12 on a conditional basis expires under subsection <br />13 (a)(1) or is terminated under subsection (c) or <br />14 whose application for such status is denied shall re- <br />15 turn to the immigration status the alien had imme- <br />16 diately prior to receiving permanent resident status <br />17 on a conditional basis or applying for such status, <br />18 as appropriate. <br />19 (2) SPECIAL RULE FOR TEMPORARY PRO- <br />20 TECTED STATUS.—In the case of an alien whose per- <br />21 manent resident status on a conditional basis expires <br />22 under subsection (a)(1) or is terminated under sub- <br />23 section (c) or whose application for such status is <br />24 denied and who had temporary protected status im- <br />25 mediately prior to receiving or applying for such sta-13 <br />EAS11295 S.L.C. <br />1 tus, as appropriate, the alien may not return to tem- <br />2 porary protected status if— <br />3 (A) the relevant designation under section <br />4 244(b) of the Immigration and Nationality Act <br />5 (8 U.S.C. 1254a(b)) has been terminated; or <br />6 (B) the Secretary determines that the rea- <br />7 son for terminating the permanent resident sta- <br />8 tus on a conditional basis renders the alien in- <br />9 eligible for temporary protected status. <br />10 (e) INFORMATION SYSTEMS.—The Secretary shall <br />11 use the information systems of the Department of Home- <br />12 land Security to maintain current information on the iden- <br />13 tity, address, and immigration status of aliens granted <br />14 permanent resident status on a conditional basis under <br />15 this Act. <br />16 SEC. 5. REMOVAL OF CONDITIONAL BASIS OF PERMANENT <br />17 RESIDENT STATUS. <br />18 (a) ELIGIBILITY FOR REMOVAL OF CONDITIONAL <br />19 BASIS.— <br />20 (1) IN GENERAL.—Subject to paragraph (2), <br />21 the Secretary may remove the conditional basis of an <br />22 alien’s permanent resident status granted under this <br />23 Act if the alien demonstrates by a preponderance of <br />24 the evidence that— 14 <br />EAS11295 S.L.C. <br />1 (A) the alien has been a person of good <br />2 moral character during the entire period of con- <br />3 ditional permanent resident status; <br />4 (B) the alien is described in section <br />5 3(b)(1)(D); <br />6 (C) the alien has not abandoned the alien’s <br />7 residence in the United States; <br />8 (D) the alien— <br />9 (i) has acquired a degree from an in- <br />10 stitution of higher education in the United <br />11 States or has completed at least 2 years, in <br />12 good standing, in a program for a bach- <br />13 elor’s degree or higher degree in the <br />14 United States; or <br />15 (ii) has served in the Uniformed Serv- <br />16 ices for at least 2 years and, if discharged, <br />17 received an honorable discharge; and <br />18 (E) the alien has provided a list of each <br />19 secondary school (as that term is defined in sec- <br />20 tion 9101 of the Elementary and Secondary <br />21 Education Act of 1965 (20 U.S.C. 7801)) that <br />22 the alien attended in the United States. <br />23 (2) HARDSHIP EXCEPTION.— <br />24 (A) IN GENERAL.—The Secretary may, in <br />25 the Secretary’s discretion, remove the condi-15 <br />EAS11295 S.L.C. <br />1 tional basis of an alien’s permanent resident <br />2 status if the alien— <br />3 (i) satisfies the requirements of sub- <br />4 paragraphs (A), (B), (C), and (E) of para- <br />5 graph (1); <br />6 (ii) demonstrates compelling cir- <br />7 cumstances for the inability to satisfy the <br />8 requirements of subparagraph (D) of such <br />9 paragraph; and <br />10 (iii) demonstrates that the alien’s re- <br />11 moval from the United States would result <br />12 in extreme hardship to the alien or the <br />13 alien’s spouse, parent, or child who is a cit- <br />14 izen or a lawful permanent resident of the <br />15 United States. <br />16 (B) EXTENSION.—Upon a showing of good <br />17 cause, the Secretary may extend the period of <br />18 permanent resident status on a conditional <br />19 basis for an alien so that the alien may com- <br />20 plete the requirements of subparagraph (D) of <br />21 paragraph (1). <br />22 (3) TREATMENT OF ABANDONMENT OR RESI- <br />23 DENCE.—For purposes of paragraph (1)(C), an <br />24 alien— 16 <br />EAS11295 S.L.C. <br />1 (A) shall be presumed to have abandoned <br />2 the alien’s residence in the United States if the <br />3 alien is absent from the United States for more <br />4 than 365 days, in the aggregate, during the <br />5 alien’s period of conditional permanent resident <br />6 status, unless the alien demonstrates to the sat- <br />7 isfaction of the Secretary that the alien has not <br />8 abandoned such residence; and <br />9 (B) who is absent from the United States <br />10 due to active service in the Uniformed Services <br />11 has not abandoned the alien’s residence in the <br />12 United States during the period of such service. <br />13 (4) CITIZENSHIP REQUIREMENT.— <br />14 (A) IN GENERAL.—Except as provided in <br />15 subparagraph (B), the conditional basis of an <br />16 alien’s permanent resident status may not be <br />17 removed unless the alien demonstrates that the <br />18 alien satisfies the requirements of section <br />19 312(a) of the Immigration and Nationality Act <br />20 (8 U.S.C. 1423(a)). <br />21 (B) EXCEPTION.—Subparagraph (A) shall <br />22 not apply to an alien who is unable because of <br />23 a physical or developmental disability or mental <br />24 impairment to meet the requirements of such <br />25 subparagraph. 17 <br />EAS11295 S.L.C. <br />1 (5) SUBMISSION OF BIOMETRIC AND BIO- <br />2 GRAPHIC DATA.—The Secretary may not remove the <br />3 conditional basis of an alien’s permanent resident <br />4 status unless the alien submits biometric and bio- <br />5 graphic data, in accordance with procedures estab- <br />6 lished by the Secretary. The Secretary shall provide <br />7 an alternative procedure for applicants who are un- <br />8 able to provide such biometric data because of a <br />9 physical impairment. <br />10 (6) BACKGROUND CHECKS.— <br />11 (A) REQUIREMENT FOR BACKGROUND <br />12 CHECKS.—The Secretary shall utilize biometric, <br />13 biographic, and other data that the Secretary <br />14 determines appropriate— <br />15 (i) to conduct security and law en- <br />16 forcement background checks of an alien <br />17 applying for removal of the conditional <br />18 basis of the alien’s permanent resident sta- <br />19 tus; and <br />20 (ii) to determine whether there is any <br />21 criminal, national security, or other factor <br />22 that would render the alien ineligible for <br />23 removal of such conditional basis. <br />24 (B) COMPLETION OF BACKGROUND <br />25 CHECKS.—The security and law enforcement 18 <br />EAS11295 S.L.C. <br />1 background checks required by subparagraph <br />2 (A) for an alien shall be completed, to the satis- <br />3 faction of the Secretary, prior to the date the <br />4 Secretary removes the conditional basis of the <br />5 alien’s permanent resident status. <br />6 (b) APPLICATION TO REMOVE CONDITIONAL <br />7 BASIS.— <br />8 (1) IN GENERAL.—An alien seeking to have the <br />9 conditional basis of the alien’s lawful permanent <br />10 resident status removed shall file an application for <br />11 such removal in such manner as the Secretary may <br />12 require. <br />13 (2) DEADLINE FOR SUBMISSION OF APPLICA- <br />14 TION.— <br />15 (A) IN GENERAL.—An alien shall file an <br />16 application under this subsection during the pe- <br />17 riod beginning 6 months prior to and ending on <br />18 the date that is later of— <br />19 (i) 6 years after the date the alien <br />20 was initially granted conditional permanent <br />21 resident status; or <br />22 (ii) any other expiration date of the <br />23 alien’s conditional permanent resident sta- <br />24 tus, as extended by the Secretary in ac- <br />25 cordance with this Act. 19 <br />EAS11295 S.L.C. <br />1 (B) STATUS DURING PENDENCY.—An <br />2 alien shall be deemed to have permanent resi- <br />3 dent status on a conditional basis during the <br />4 period that the alien’s application submitted <br />5 under this subsection is pending. <br />6 (3) ADJUDICATION OF APPLICATION.— <br />7 (A) IN GENERAL.—The Secretary shall <br />8 make a determination on each application filed <br />9 by an alien under this subsection as to whether <br />10 the alien meets the requirements for removal of <br />11 the conditional basis of the alien’s permanent <br />12 resident status. <br />13 (B) ADJUSTMENT OF STATUS IF FAVOR- <br />14 ABLE DETERMINATION.—If the Secretary deter- <br />15 mines that the alien meets such requirements, <br />16 the Secretary shall notify the alien of such de- <br />17 termination and remove the conditional basis of <br />18 the alien’s permanent resident status, effective <br />19 as of the date of such determination. <br />20 (C) TERMINATION IF ADVERSE DETER- <br />21 MINATION.—If the Secretary determines that <br />22 the alien does not meet such requirements, the <br />23 Secretary shall notify the alien of such deter- <br />24 mination and, if the period of the alien’s condi- <br />25 tional permanent resident status under section 20 <br />EAS11295 S.L.C. <br />1 4(a)(1) has ended, terminate the conditional <br />2 permanent resident status granted the alien <br />3 under this Act as of the date of such deter- <br />4 mination. <br />5 (c) TREATMENT FOR PURPOSES OF NATURALIZA- <br />6 TION.— <br />7 (1) IN GENERAL.—For purposes of title III of <br />8 the Immigration and Nationality Act (8 U.S.C. 1401 <br />9 et seq.), an alien granted permanent resident status <br />10 on a conditional basis under this Act shall be consid- <br />11 ered to have been admitted as an alien lawfully ad- <br />12 mitted for permanent residence and to be in the <br />13 United States as an alien lawfully admitted to the <br />14 United States for permanent residence. <br />15 (2) LIMITATION ON APPLICATION FOR NATU- <br />16 RALIZATION.—An alien may not apply for natu- <br />17 ralization during the period that the alien is in per- <br />18 manent resident status on a conditional basis under <br />19 this Act. <br />20 SEC. 6. REGULATIONS. <br />21 (a) INITIAL PUBLICATION.—Not later than 180 days <br />22 after the date of the enactment of this Act, the Secretary <br />23 shall publish regulations implementing this Act. Such reg- <br />24 ulations shall allow eligible individuals to apply affirma-21 <br />EAS11295 S.L.C. <br />1 tively for the relief available under section 3 without being <br />2 placed in removal proceedings. <br />3 (b) INTERIM REGULATIONS.—Notwithstanding sec- <br />4 tion 553 of title 5, United States Code, the regulations <br />5 required by subsection (a) shall be effective, on an interim <br />6 basis, immediately upon publication but may be subject <br />7 to change and revision after public notice and opportunity <br />8 for a period of public comment. <br />9 (c) FINAL REGULATIONS.—Within a reasonable time <br />10 after publication of the interim regulations in accordance <br />11 with subsection (b), the Secretary shall publish final regu- <br />12 lations implementing this Act. <br />13 (d) PAPERWORK REDUCTION ACT.—The require- <br />14 ments of chapter 35 of title 44, United States Code (com- <br />15 monly known as the ‘‘Paperwork Reduction Act’’) shall <br />16 not apply to any action to implement this Act. <br />17 SEC. 7. PENALTIES FOR FALSE STATEMENTS. <br />18 Whoever files an application for any relief or benefit <br />19 under this Act and willfully and knowingly falsifies, mis- <br />20 represents, or conceals a material fact or makes any false <br />21 or fraudulent statement or representation, or makes or <br />22 uses any false writing or document knowing the same to <br />23 contain any false or fraudulent statement or entry, shall <br />24 be fined in accordance with title 18, United States Code, <br />25 imprisoned not more than 5 years, or both. 22 <br />EAS11295 S.L.C. <br />1 SEC. 8. CONFIDENTIALITY OF INFORMATION. <br />2 (a) PROHIBITION.—Except as provided in subsection <br />3 (b), no officer or employee of the United States may— <br />4 (1) use the information furnished by an indi- <br />5 vidual pursuant to an application filed under this <br />6 Act in removal proceedings against any person iden- <br />7 tified in the application; <br />8 (2) make any publication whereby the informa- <br />9 tion furnished by any particular individual pursuant <br />10 to an application under this Act can be identified; or <br />11 (3) permit anyone other than an officer, em- <br />12 ployee or authorized contractor of the United States <br />13 Government or, in the case of an application filed <br />14 under this Act with a designated entity, that des- <br />15 ignated entity, to examine such application filed <br />16 under such sections. <br />17 (b) REQUIRED DISCLOSURE.—The Attorney General <br />18 or the Secretary shall provide the information furnished <br />19 under this Act, and any other information derived from <br />20 such furnished information, to— <br />21 (1) a Federal, State, tribal, or local law enforce- <br />22 ment agency, intelligence agency, national security <br />23 agency, component of the Department of Homeland <br />24 Security, court, or grand jury in connection with a <br />25 criminal investigation or prosecution, a background <br />26 check conducted pursuant to section 103 of the 23 <br />EAS11295 S.L.C. <br />1 Brady Handgun Violence Protection Act (Public <br />2 Law 103–159; 18 U.S.C. 922 note), or national se- <br />3 curity purposes, if such information is requested by <br />4 such entity or consistent with an information shar- <br />5 ing agreement or mechanism; or <br />6 (2) an official coroner for purposes of affirma- <br />7 tively identifying a deceased individual (whether or <br />8 not such individual is deceased as a result of a <br />9 crime). <br />10 (c) FRAUD IN APPLICATION PROCESS OR CRIMINAL <br />11 CONDUCT.—Notwithstanding any other provision of this <br />12 section, information concerning whether an alien seeking <br />13 relief under this Act has engaged in fraud in an applica- <br />14 tion for such relief or at any time committed a crime may <br />15 be used or released for immigration enforcement, law en- <br />16 forcement, or national security purposes. <br />17 (d) PENALTY.—Whoever knowingly uses, publishes, <br />18 or permits information to be examined in violation of this <br />19 section shall be fined not more than $10,000. <br />20 SEC. 9. The legislation would transfer the fate of the wolves from federal hands into state hands. Today, the Colorado Senate passed legislation which will give undocumented youth a chance. Senate Bill 126 will give children of undocumented immigrants in-state tuition rates, but nothing else.</p> <p><img style="display: block; float: none; margin-left: auto; margin-right: auto" title="Students Stand Up For Colorado Asset" alt="Students Stand Up For Colorado Asset" src="http://static.technorati.com/11/02/18/27369/assett-studentssm.JPG" /></p> <p>While federal law requires all children attend school under the decision of<a href="http://www.americanpatrol.com/REFERENCE/PlylerVDoeSummary.html"> Plyer V. Doe</a>, after graduating from high school all bets are off. Immigrant youth who were brought to the US by their parents and have lived in Colorado nearly all of their lives are simply out of luck. Assuming Colorado colleges admit them at all, the youths must pay out-of-state tuition rates. <a href="http://www.ednewscolorado.org/2011/02/02/13003-supporters-rally-behind-in-state-tuition-bill">They are not eligible for scholarships</a>. That puts college out of reach of most children of undocumented youth. They are mostly from poor families who barely pay basic bills, must less can afford send their children to higher education at out-of-state tuition rates.</p> <p>Such cold realities <a href="http://www.scribd.com/doc/6915923/A-New-War-on-Poverty">ensures poor people stay poor</a>. Statistics show youth who are victims of poverty do well when sent to college. It is a chance to break the chain of poverty handed down from one generation to the next. Many youths who go to college work hard to pass the opportunity along to their own children, hence improving society. Sadly, for undocumented youth, such dreams remain the luxury for others. </p> <p>Since<a href="http://www.tjtaxlaw.com/Willfulness.pdf"> most youth were not old enough to understand the gravity of crossing the border without inspection</a>, they become victims of those who insist on denying the youth of undocumented immigrants opportunities as a way of getting even for the acts of the parents of the youth. The chief complaint was the children would compete with US citizen youths for scholarships and student loans. The proposal in front of the Colorado legislature prohibits use of state funding. In fact, as massive cuts in education were proposed by legislatures, the undocumented youths could be what is keeping college doors open. According to a press release from <a href="http://www.heaacolorado.org/documents/ColoradoASSETonepager.pdf">Colorado Asset</a>, which supports the bill, when the state of Texas granted in-state tuition to undocumented youths, there was an increase in student paid tuition by over $27 million dollars the first year.</p> <p>"This bill has always been the right thing to do, but now it is the economically smart thing to do.” said <a href="http://coloradosenate.org/home/press/senators-giron-and-johnston-unveil-asset-bill">Sen. Angela Giron</a> (D-Pueblo) who co-sponsored the bill with Sen. Mike Johnson (D-Denver). “We must ensure that Colorado's economy is built on the foundation of a talented, educated, innovative and diverse workforce."</p> <p> </p> <p> </p> <p>This bill should not be confused with the <a href="http://dreamact.info/">Dream Act</a> which was defeated in the US Senate during the lame duck session of 2010. The Dream Act would allow children of undocumented youth the chance to go to school or serve in the military. In fact, the entire peace process between the two countries is clearly at stake. </p> <p> </p> <p>At the same time, the fledgling Egyptian military government has it's own hands full. Many Jews resent the Camp David Peace Accords in which Israel gave up the Sinai Peninsula, won in the 1967 war, in exchange for lasting peace with Egypt, according to columnist Joe Hilliker of the Trumpet.com. The agreement cost Egyptian President Anwar al-Sadat his life. His successor, now Past Pres. Hosni Mubarak, respected the Camp David Accords, hence continuing the peace for 30 years. Not all was lost under Mubarak. US democratic principles suggest mixing a state religion with government can lead to oppression of the minority, an un-democratic principle. It precludes minority religious voices from representation and an opportunity to be heard and excuses the country from the obligation to protect the few from the majority, often the necessary job of a democracy. While the Muslim Brotherhood in Egypt believes in peaceful processes, and decried the 911 attacks on the twin towers in New York, suspected splinter groups are violent and not Western friendly. The benefit of a controlling entity for 30 years is the consistency of the ruling government, for good or for bad. While Egypt has maintained a stable position towards Israel throughout a series of leadership changes in the US, the US rarely maintains the same stable point of view. With each new presidential cycle comes new priorities and a new leadership direction. Hence, Egypt cannot be expected to side eternally with US policy in the Middle East if it sides with our political point of view at all. When Pres. Barak Obama sided with the Egyptian people he was siding with the people who reflect American values, that is, he was siding with democracy. One bad part of a controlling entity for 30 years are the civil rights abuses that strong-arm governments effect upon their people. </p> <p align="left"> </p> <p align="left"> </p> <p align="left"> </p> <p align="left"> </p> <p align="left"> </p> <p align="left">None of this matters to an ecstatic population in Egypt tonight as they celebrate liberty won in just 18 days. From another point of view, the freedom won today when Hosni Mubarak stepped aside has taken 18 days of gut wrenching protests preceded by 30 years of political oppression. How tragic it would be to endure those 30 years plus 18 days only to lose one's life in a war that otherwise would never have taken place. Eternal hope exists the citizens of Egypt will choose their government wisely.  At the same time, those who truly believe in freedom and democracy understand freedom is a process and encourage the birth of a new society, even if it does not side with current political positions. He continued the same promises made before, to not run for reelection in September and to support reforms to assure a new generation of leaders take over the Egyptian country through elections. </p> <p><img alt="" src="http://static.technorati.com/11/02/10/26907/mubarak-iismall.JPG" /></p> <p>“I announce in very plain unequivocal words that I will not run in the coming presidential elections. I announce I will … continue to shoulder my responsibility until the authority and power is handed over to the people in elections this coming September.”</p> <p>“Go! Go! Leave! Leave!” an angry crowd yelled in response.</p> <p>“I will not take orders from anyone”, Mubarak said, a possible reference to activists <a href="http://timesofindia.indiatimes.com/world/middle-east/Mubarak-addresses-nation-refuses-to-step-down-as-President/articleshow/7472083.cms">who demand he leave office immediately</a>. The statement might also reflect subtle pressure from world leaders including <a href="http://www.allvoices.com/contributed-news/8102206-barack-obama-made-indications-that-hosni-mubaraks-should-resign-now">President Obama</a>, encouraging Mubarak to step down.</p> <p><img style="display: inline; float: left" alt="" align="left" src="http://static.technorati.com/11/02/10/26907/protesters-sky-viewsm.JPG" /></p> <p>In Egypt’s second largest city, Alexandria, a large crowd changed from scenes of jubilation to a demonstration of anger, crying, shouting and obscenities. Thousands poured into the streets on their way to rally at the nearby military base. Citizens are calling upon the Egyptian army to force Mubarak to resign. </p> <p>It was an announcement by a military leader in Liberation Square earlier in the day that sparked the protest today. Gen. President Mubarak did not chair the counsel, as he usually would. Instead, Mohamed Tantawi, Egypt’s defense minister, chaired the meeting. The counsel indicated it would convene in a continuous session to safeguard the Egyptian people, a signal they were in effect taking control of the government. According to organizers, Mexican American Studies class informs and motivates students. Some of it's goals include:  </font></p> <ul> <li><font face="Raavi">Working towards the invoking of a critical consciousness within each and every student; Promoting and advocating for social and educational transformation; </font></li> <li><font face="Raavi">Promoting and advocating for the demonstration of respect, understanding, appreciation, inclusion, and love at every level of service.</font></li> </ul> <p><font face="Raavi">However, newly elected </font><a href="http://technorati.com/Direct%20More%20Money%20Into%20the%20Classroom"><font face="Raavi">Arizona Schools Superintendent John Huppenthal</font></a><font face="Raavi"> told the TUSD to halt classes or it would lose $15 million dollars in annual state funds. The threat breaks Huppenthal's promise to "Direct More Money Into the Classroom...too many of our education dollars are wasted on administrative bloat. </script></div>Unknownnoreply@blogger.com0tag:blogger.com,1999:blog-9190013883554418548.post-48248834513584496922011-01-15T17:48:00.000-07:002011-01-15T18:00:15.245-07:00Will The Insanity Defense Work For Jared Loughner?<p><em><font face="Arial">Many people have been asking me about the insanity defense and about charging Jared Loughner, the mentally deranged youth who shot Congresswoman Gabrielle Gifford's.  Of course, a court will weigh in on the topic as will attorney for the prosecution and defense.  However, in short, here are some thoughts.</font></em></p> <p><em><font face="Arial">When an attorney writes these kinds of articles there is always someone who misunderstands.  We are so used to rooting for “our side”, we take anyone who makes points about the other side as a traitor.  What Jared Loughner did was a horrible thing.  However, you can bet at least his attorney is looking at this case from every angle.  That is what an informed person does.</font></em></p> <p><em><font face="Arial">This Article was originally printed as <a title="http://blogcritics.org/culture/article/why-tucson-shooter-is-not-a/" href="http://blogcritics.org/culture/article/why-tucson-shooter-is-not-a/">/</a><a href="http://blogcritics.org/culture/article/why-tucson-shooter-is-not-a/">Why Tucson Shooter Is Not a Terrorist</a> on Blogcritics, by Tim Paynter</font></em></p> <p> </p> <p>Many people have been asking, "Shouldn’t the Tucson shooter be considered a terrorist," and "Shouldn’t he be tried and executed if guilty?" It is hard to explain diminished mental capacity but let me give it a try.</p> <p><img alt="" src="http://static.blogcritics.org/11/01/12/151483/paranoid-schitzophrenic-smii.jpg" /></p> <p>Certainly the acts which Jared Lee Loughner committed are heinous. He has left an entire nation in shock, many dead, others clinging to an altered life, and the Jewish and immigrant communities in horror. Nothing I say here should be construed as justifying or excusing Loughner's acts.</p> <p>Turning to the shooter, who is also a victim, what do we make of him? If your three-year-old daughter found an automatic pistol on the ground and shot people as Loughner did, would you charge her with first degree premeditated murder and seek the death penalty?</p> <p>The analogy between a three-year-old and Loughner is not exact. If he had the mental capacity of a three-year-old at his age, he would be retarded. However, he likely is so mentally ill that he is out of touch with reality. Paranoid, he did not have the capacity to make rational decisions. Mental retardation and mental illness, while not the same, have one thing in common: <a href="http://www.mayoclinic.com/health/paranoid-schizophrenia/DS00862">the diminished capacity to make rational decisions</a>.</p> <p>In criminal law, two elements are required to make a person guilty of a serious crime: the <em><a href="http://www.duhaime.org/LegalDictionary/M/MensRea.aspx">mens rea</a></em>, or guilty mind, and the <em><a href="http://www.wisegeek.com/what-is-actus-reus.htm">actus reus</a></em>, the guilty act. Proving the actus reus will be easy, considering the witnesses. However, proving the mens rea could be a challenge if the insanity defense is asserted.</p> <p>If Loughner was insane when he committed the acts, then he is technically not guilty of the crimes of which he is accused. In that case, under criminal law theory, he was not capable of forming the <em>mens rea</em>. We don’t hold three-year-olds responsible for things they cannot understand. We should not hold a criminally insane person guilty either.</p> <p>Loughner voluntarily withdrew from Pima Community College after <a href="http://www.examiner.com/depression-in-west-palm-beach/jared-loughner-why-the-insanity-defense-won-t-work">five encounters with law enforcement</a> and a series of angry and irrational acts. The school told him not to come back until he had an evaluation from a mental health professional stating he was not a danger. Loughner writes about a new form of currency, among other senseless ramblings. He writes in legible sentences but what he talks about does not make sense.</p> <p>That is why Loughner is not a terrorist. A terrorist acts with a full deck. He may be consumed with anger or allegiance to a cause, but he is rational. He is not marching to the voices in his head or having paranoid delusions. He may justify his actions by a belief in God, but God or the Devil or irrational thinking is not screaming in his ears to wreak total destruction on society. He does it anyway.</p> <p>If, by a long shot, Loughner is found "guilty but insane," meaning the prosecution can prove the actus reus but the defense can show lack of the mens rea, he could be sentenced to a mental institution under <a href="http://www.azleg.state.az.us/FormatDocument.asp?inDoc=/ars/13/00502.htm&Title=13&DocType=ARS">Arizona Revised Statutes 13-502(D)</a> for the same term he would have been sentenced to prison if he were found guilty without being insane. That means life. <a href="http://www.azcentral.com/news/articles/2011/01/11/20110111Gabrielle-Giffords-arizona-shooting-jared-loughner-trial.html">The insanity defense</a> will leave Loughner in an institution for the criminally insane instead of prison if he is prosecuted under state statutes. Hence, the insanity defense may not be a rational option if Arizona's facilities for the criminally insane are as abysmal as their draconian mental health laws.</p> <p><img alt="" src="http://static.blogcritics.org/11/01/13/151483/GET-OUT-OF-JAIL-YELLOSSMii.jpg" width="450" height="150" /></p> <p>After <a href="http://www.youtube.com/watch?v=3Bj6aOgfcJU">John Hinckley</a> took the insanity defense for shooting President Reagan, a host of states passed “guilty but insane laws.”  They were afraid Hinckley would <a href="http://articles.chicagotribune.com/2003-11-18/news/0311180124_1_federal-judge-heard-testimony-federal-prosecutors-contend-hinckley-shooting-reagan-and-three">be cured of his mental illness</a> through medication.  He likely was cured.  He would then escape responsibility and be out of the institution in a year.  The thinking shows ignorance about how the system works.  Hinckley is still not free. </p> <p>Should we put our <a href="http://www.abanet.org/crimjust/juvjus/hain.html">three-year-old girl</a> who finds a gun on the sidewalk and shoots people in prison <a href="http://www.abanet.org/crimjust/juvjus/jdppolicy.html">when she turns 18</a>?  By then, she will understand the nature of her actions, even though she didn't at the time.  Should we force a person committed to a mental hospital to stay for life even after a cure for his condition is found?  When cured, he, like the three-year-old turned 18, will understand the nature of what he has done, <a href="http://www.psychologyinfo.com/DJF/diminished_capacity.html">although he didn't at the time</a>. </p> <p>It is <a href="http://www.progress.org/fold56.htm">vindictive</a> to punish a person with a diminished mental capacity once he regains that capacity.  At the same time, Arizona refused to provide mental health treatment when it could do the most good.  Under Arizona law, presuming medication cures him, Loughner would take up valuable space in a mental institution as if he were in a prison.  How draconian to punish a person who regains his mental capacity for acts he committed before he had the capacity. </p> <p>It is bad enough to say Loughner is a victim of a health care system which ignores mental illness, but he is not the only victim. Congresswoman Giffords and the other people shot on Saturday are also victims of the same uncaring health care system. If Arizona had adequately funded health care for the mentally ill, Loughner would have been treated or institutionalized until sane.</p> <p>Rather than fund health care, the Arizona legislature is spending millions of dollars defending the law which makes them famous, SB 1070, the most vicious anti-immigrant law in the state's history. A national <a href="http://technorati.com/politics/article/immigrants-call-for-national-bud-lite/">boycott is costing the state billions</a>. Rather than fund health care on a national basis, the Republican Senate Caucus enacted a “<a href="http://www.politifact.com/florida/promises/scott-o-meter/promise/730/bring-arizonas-immigration-law-florida/">No Vote Pact</a>” in which they refused to vote on any issues including the START Treaty to reduce nuclear proliferation until Democrats conceded to give every millionaire a $139,000 unfunded tax cut. With their pockets stuffed full of taxpayer money, the Republicans vow to repeal health care for the poor.</p> <p>Shortly, Congresswoman Giffords and all of us will become victims one more time. Despite surely suffering extreme mental illness, Loughner will likely be judged mentally ill, but with enough capacity to know right from wrong. The Court will distinguish between mental illness and insanity. Rather than <a href="http://www.mentalhelp.net/poc/view_doc.php?type=doc&id=41653">get treatment in a mental institution</a>, Loughner will spend his life on death row. The message to other mentally ill people is, don’t reveal yourself, because you won’t get treated and your acts will be judged harshly. He says competition is heating up for his rental units and vacancy rates have plummeted.</p> <p>“We don’t have any single family homes available” the lanky investor told me during an exclusive interview. “They don’t stay for rent longer than a week or so.” </p> <p>When asked about two bedroom apartments Beran was only able to offer one prospect for a fast move. </p> <p>“It is the trickle down effect,” Beran said during our discussion in his nicely appointed office on South Broadway Boulevard in Denver. Unlike “trickle down economics” in which wealth trickles down from the super rich to the middle class as promised by the Bush administration, the trickle down effect Beran is talking about is from those transitioning from home owners to small house and apartment renters after losing their homes in foreclosure.</p> <p>“The banks aren’t letting people stay in their homes any more,” Beran explained. “So people are moving from large houses into anything we have.” The same is true for apartments, as people face a substantial lower standard of living after losing their homes and condos and being forced to accept significantly less.</p> <p><img alt="" src="http://static.technorati.com/11/01/13/25011/performance-property-officesm.JPG" /></p> <p>Even though a person has a foreclosure or bankruptcy on their record Beran may still work with the tenant. </p> <p>“I like to work with people to see if we can help them. If I am convinced they will pay the rent then we overlook a lot,” he told me.</p> <p>Beran qualifies the tenant by checking their criminal and civil background. He is looking for serious criminal charges as well as prior evictions. Assuming the person has stable employment, the Denver leasing agent tries to put them into something they can presently afford.</p> <p>All of this is good news for landlords trying to hang onto their properties and for new investors. Sales prices still remain competitive in Denver. There are scores of fixer uppers on the market. An investor who is able to buy right can lease the property for positive cash flow. One bedroom units rent for $550 to $595 in lower income complexes, which are favored by investors. This provides the perfect scenario for a wise investor who has capital to invest and management expertise. As credit eases, values will likely rise. The Republican legislators who propose the law define a State Citizen as a person “Who owes no allegiance to any foreign sovereignty, or a child without citizenship or nationality in any foreign country” </font><a href="http://www.ajc.com/news/georgia-politics-elections/states-seek-to-deny-795912.html"><font face="Arial">reports AJC of Atlanta</font></a><font face="Arial">, Georgia.  If the child owes no citizenship to another country then no country would be obligated to take him as one of their own. While immigrant’s rights groups have been protesting for comprehensive <a href="http://www.nilc.org/immlawpolicy/CIR/cir031.htm">immigration reform</a> and the <a href="http://dreamact.info/">Dream Act</a>, a travesty of justice has been taking place in a silent corner of the immigrant community. Unbeknownst to most, the Immigration and Customs Enforcement Administration (ICE) has been busy deporting veterans.<br />

The most recent victim of an “<a href="http://www.cbsa-asfc.gc.ca/media/facts-faits/051-eng.html">Order For Removal</a>” is Manuel Valenzuela who survived another round in the government’s effort to deport him today. <a href="http://www.blogger.com/ww.thedenverchannel.com/news/25107233/detail.html">Valenzuela appeared in Denver Immigration Court</a> dressed in a tightly fitting Marine Corp uniform. His continued fight was placed on the docket for September of 2012 in endless legal wrangling perhaps even the judge did not understand.<br />

“Is Mariela Sogastume representing you?” the judge asked.<br />
<br />
“Yes, Sir!” replied Valenzuela.<br />
<br />
You could not help but notice this was not the ordinary “Yas, your honor” reply. In fact, Valenzuela responded to the judge as if he were summoned by the general. If you didn’t get the point with the uniform, the manner and directness of his reply screamed “I am a veteran!”<br />
<br />
Yes, the uniform was tightly fitting. What do you expect after being out of the service for over 25 years? Yep. Manuel not only is a veteran, he is a Viet Nam veteran. He is the same guy who volunteered for service when an entire generation was seeking refuge in college. They called it "deferment" in those days. The idea was to go to school for so long that the war would be over before the student could graduate.<br />
<br />
Maybe something good came out of Nam after all. Thousands of not-so-studious youths got multiple degrees in perfectly useless things like geology while waiting for others to get the dirty work over with, or die trying. Lots of soldiers died trying.<br />

Needless to say, as men bled to death in Southeast Asian rice paddies, and a nation started singing <a href="http://www.cyberhymnal.org/htm/k/u/kumbayah.htm">Kum Ba Yah</a>, Manuel was facing Viet Cong resistance flying rescue missions into mainland hot zones and pulling other soldiers out of harms way. These were the days when <a href="http://www.britannica.com/EBchecked/topic/628305/Viet-Cong">VC commandants</a> considered soldiers more expendable than bullets because they had a lot more manpower than gun powder, and they had plenty of both!<br />

<div style="background-color: transparent; border: medium none; color: black; overflow: hidden; text-align: left; text-decoration: none;"> The news was all about “body counts” and we are not talking about how many hippies you can stick into a VW bug. This was a guerilla war of attrition in which uniforms were not always worn and the enemy spy was flashing a smile at you during the day because he planned to come back and gut you after dark.<br />

One of the reasons why deporting of veterans has remained so quiet is most of them don’t consider themselves immigrants. Valenzuela came here as a little tike, the child of a US citizen born in New Mexico. Everything about him says US citizen. If Uncle Sam is successful in his effort to repatriate a 50 plus year old to his “homeland” it will be to a place he hardly knows, with no means of support, with no family. Imagine waking up and finding you don’t have a country any more, or the country you volunteered to die for does not want you. If you can’t fathom how it would feel, Valenzuela has a word for it. “Devastating.” Marines don’t cry. Often. At least not in public.<br />
<br />
Lest you think this is <a href="http://www.orangejuiceblog.com/2010/09/fullerton-ice-raid-detained-abused-workers/">one lone royal foul up by ICE</a>, there are two Valenzuelas facing deportation. Manuel’s brother, Valente, also is doing battle with an ungrateful ICE. Valente had a special clearance that put him in working contact with the three letter boys. If he ever gets through his own deportation nightmare he may write a best seller about his work with the CIA in far off jungles and his exposure to Agent Orange.<br />
<br />
At the end of his tour, Valente came home with a bronze star and a lifetime of nightmares and post traumatic stress, the nightmares and post traumatic stress being gifts he shares in common with brother Manuel. <a href="http://www.aclu.org/immigrants-rights/local-ice-raid-raises-humanitarian-and-civil-rights-violation-concerns">Lest you think these are two lone royal foul ups by ICE</a>, ask the brothers to <a href="http://www.cnsnews.com/news/article/immigrant-veterans-face-deportation-desp">talk about the many veterans who have contacted them</a> after already being deported.<br />

Lest you think<a href="http://www.veteransforcommonsense.org/index.php/archives/918-steve-liewer#"> the USA has an odd way of showing gratitude</a> towards its veterans, well you are damn right about that. In fact, maybe they should put “We Deport Veterans” on the recruiting posters along with “See The World!”</div><div style="background-color: transparent; border: medium none; color: black; overflow: hidden; text-align: left; text-decoration: none;"></div><br />

Her court room decorum tells you this is a pro without the immense ego most legal beagels carry with them. Her modesty comes from her own struggles and personal experience as an immgrant in the land of Oz. Mariela Sogastume "get's it" when someone faces injustice, which gives her a quiet passion about her work.<br />

Perhaps it was a good day in immigration court. Before the proceeding was adjourned, an “officer of the court” which is a code word in the legal profession for “attorney”, announced he must say something in Manuel’s defense.<br />

“Your honor.” the man insisted. “I am an officer of the court and a veteran myself.” and then turning to Valenzuela he shouted in a voice which needed no loud speaker to amplify it. “And I salute you!” Perhaps he wished he had become a rich geologist instead of a hard working attorney, perhaps not, but there was no mistaking his patriotism!<br />
<br />
Everyone froze for just a second after the words zinged through the air. The question for the rest of us who are grateful for men who put their lives on the line for their country, is this the way to treat a veteran? I felt like standing up and joining the salute and then parading out onto the street in protest. This can’t be happening in America, and if it is, it must stop. That was my impression, and U? <br />

The failed <a href="http://www.foia.cia.gov/bay_of_pigs.asp">CIA</a> invasion of the Bay of Pigs, the <a href="http://www.hpol.org/jfk/cuban/">Cuban missile crisis</a> which nearly brought an end to the world as we know it and a <a href="http://articles.cnn.com/2009-05-04/politics/cuba.embargo_1_tourists-on-cuban-beaches-communist-island-cuban-government?_s=PM:POLITICS">trade embargo</a> that continues to this day, contribute to frigid relations. </p> <p>However, Cuba, desperate for outside currency, has launched a series of reforms which suggest the country is moving in a more civil direction. <a href="http://www.michaeldiazjr.com/2010/11/cuba-attempts-at-privitization/">Moves towards privatization</a> were recently announced by Raul Castro, who has taken the reigns from his brother Fidel. </p> <p>A new entrepreneurial, if not capitalistic, economy is being encouraged. The Cuban government seeks to create a new private sector to help replace jobs lost in a series of massive government layoffs.  Political prisoners who criticized the government <a href="http://abcnews.go.com/International/cuba-agrees-release-52-political-prisoners/story?id=11116577">are being released</a> from Cuban prisons after being silenced for years, although 11 still marked their eighth Christmas in prison this year. </p> <p>The Cuban administration seeks to establish Cuba as <a href="http://rapidsharedownloadz.com/76925/files/cuba+travel+guide.html">a first class tourist destination</a>.  In a recent agreement, Cuba agreed to cut the taxes it charges on Western Union money transfers sent to the island nation, thus causing an immediate rise in transfers over the 2010 holiday season, says the <a href="http://www.buenosairesherald.com/article/54922/cuba-eliminates-taxes-for-us-money-transfers">Buenos Aires Herald</a>.  The Cuban government continually seeks the dropping of the trade embargo, and<a href="http://www.ub40.co.uk/forum/general-anarchy/601706-us-economic-blockade-cuba.html"> the international community agrees</a>. Clearly, these moves are a positive step forward in the argument for normalization of relations with Cuba.</p> <p>Yet, Cuban leadership insists on shooting itself in the foot each time it has a chance to join the international community. Recently, the country took a nasty swipe at the U.S, <a href="http://www.heritage.org/research/reports/1994/11/bg1010nbsp-why-the-cuban-trade">reminding conservatives why</a> relations should stay in the deepfreeze. In some circumstances, the information may actually put US operatives lives at risk or jeopardize undercover operations.  One of those operatives may have been the victim of sex crimes by Wiki Leaks founder, Julian Assange. <a href="http://static.technorati.com/10/12/26/24095/500x-annaardinsm.jpg"> Anna Ardin</a> of Sweeden made various trips to Cuba between 2002 and 2006, says<a href="http://www.miamiherald.com/2010/12/08/v-fullstory/1962779/accuser-in-wikileaks-saga-has.html#ixzz17WpHansS"> the Miami Herald</a>.  Ardin has written for a Cuba dissident publication and been associated with a political movement which encourages anti-Semitic remarks.  </p> <p>Even if the actions of the Cuban government do not pose significant security threats to the U.S., since the information is available elsewhere, it is a reminder the Castro's wish to cause harm to the U.S. even as they seek normalization of relations.</p> <p>Sooner or later the US is bound to drop the trade and tourist embargo which plagues Cuba. Republicans refused, and launched a smear campaign against the Act, calling it </strong></font><a href="http://www.villagevoice.com/2010-07-13/news/ronnie-s-kids-the-bright-side-of-amnesty/"><font face="Andalus"><strong>Amnesty</strong></font></a><font face="Andalus"><strong>, something it clearly was not.  Hispanic leaders, immigrant youth and a nation pulling for young people who merely want a taste of the American Dream were crushed when Republicans snuffed out the under dog like it was a cigarette under the heel of their boot.</strong></font></p> <p><font face="Andalus"><strong>The </strong></font><a href="http://www.opencongress.org/people/representatives"><font face="Andalus"><strong>Development, Relief and Education of Alien Minors Act</strong></font></a><font face="Andalus"><strong> was designed to protect those few minor children of undocumented workers who were brought here when most of them were too young to remeber.  While their parents may have broken the law, only a </strong></font><a href="http://kidshealth.org/parent/emotions/behavior/bullies.html"><font face="Andalus"><strong>bully</strong></font></a><font face="Andalus"><strong> punishes a child for the mistakes of his parents. Yet Senator Graham tongue-lashed the eager youths with remarks blaming the young people for their valiant fight for basic civil rights.</strong></font></p> <p><font face="Andalus"><strong>“To those who have come to my office...you are wasting your time” he said from the Senate floor.</strong></font></p> <p><font face="Andalus"><strong>Graham then blamed the youths for damaging the hopes for over-all comprehensive immigration reform for all immigrants in 2011.  The proposed law is called CIR, or </strong></font><a href="http://ezinearticles.com/?CIR-ASAP---A-Step-in-the-Right-Direction&id=3603575"><font face="Andalus"><strong>CIRASAP</strong></font></a><font face="Andalus"><strong> indicating the urgency of the law, Comprehensive Immigration Reform As Soon As Possible.</strong></font></p> <p><font face="Andalus"><strong>“What they have done on the Dream Act is hurt overall comprehensive immigration reform,” Graham said after the Seante vote, </strong></font><a href="http://thehill.com/blogs/blog-briefing-room/news/134365-graham-dream-act-push-hurt-wider-immigration-reform-effort"><font face="Andalus"><strong>according to The Hill</strong></font></a><font face="Andalus"><strong>.</strong></font></p> <p><font face="Andalus"><strong>Graham's remarks were cruel words for the young people leaving the nation's capitol with tears streaming down their cheeks.  Graham has done everything in his power to block both the Dream Act and CIR. John McCain (R-AZ) broke his word to the Dream Activists, after first promising to support immigration reform along with Edward Kennedy, and then turning his back on the students completely. He steadfastly refused to meet with student leaders even though they were camped in the summer blaze in front of his Phoenix, Arizona, office for weeks this year.</strong></font></p> <p><font face="Andalus"><strong>Sen. Kay Bailey Hutchinson (R-TX) ridiculed the students as they held hunger strikes that lasted for over 28 days. Sen. Hutchinson had the students arrested when they refused to leave her office blaming it on the landlord. Clearly, a powerful Republican Party is beating up on the weakest in society, while mocking the students for their efforts.</strong></font></p> <p><font face="Andalus"><strong>Hispanics have been putting up with an aggressive anti-immigrant stance from Republicans for a long time. However, while adult immigrants have weathered the icy reception, the Republican whipping with rude and disrespectful remarks to immigrant children will likely be a regrettable mistake. As the GOP searches for an expanded base, they can write off Latinos after the way they have treated the children of the community.</strong></font></p> <p><font face="Andalus"><strong>A few Democrats are in hot water with Latino voters, as well.  Mark Pryor of Arkansas, Ben Nelson of Nebraska, two Montana senators, Jon Tester and Max Baucus, and Kay Hagan of North Carolina all refused to support the Dream Act.  Sen. Joe Manchin of West Virginia didn't even bother to attend the vote for the Dream Act or for the vote for gays in the military known as Don't Ask, Don't Tell.  Manchin was too busy having fun at a family party, reports the web publication, </strong></font><a href="http://www.politico.com/news/stories/1210/46573.html"><i><font face="Andalus"><strong>Politico</strong></font></i></a><font face="Andalus"><strong>.</strong></font></p> <p><font face="Andalus"><strong>In the meantime, immigrant youth have placed their futures in the hands of people who are supposed to know what wisdom is. They are speaking about raising the age to qualify for social security, severe cuts in health care, closing of schools, removal of the mortgage tax deductions for home owners and a host of other sacrifices under an austerity program which inevitably leads to a significant lower standard of living for most. </font></p> <p><font face="Aharoni">As champions of the austerity program, the Republican Caucus exhibits the worst kind of leadership possible. This news certainly draws attention to the actions the President can take to end the discharges, and it's important that we continue to urge him to do so. Aside from that, I also wanted to share some late breaking news that keeps congressional repeal as a possibility THIS YEAR. </p> <p> <br />After the <a href="http://www.cbsnews.com/8301-503544_162-20025221-503544.html">failed vote</a> to bring up the Defense Authorization bill today, two champions for repeal – Senators Joe Lieberman and Susan Collins – announced that they would introduce repeal of "Don't Ask, Don't Tell" as a stand-alone piece of legislation. While passing this new bill will be an uphill battle, it is another chance for a durable legislative solution. </p> <p> <br />Over the past few days we've seen a number of senators speak out for repeal and it's clear that under the right circumstances, we can get above the 60 votes needed to overcome a filibuster. What got in the way today was procedure. <br /></p> <p>Thankfully a bipartisan group of senators has committed to finding an alternative method of achieving repeal. We encourage all senators to take up this bill and pass it quickly so that the military has the power to implement a repeal of "Don't Ask, Don't Tell." </p> <p> <br />I'll be in touch in the coming days to give you ways to get involved and help pass this stand-alone bill to repeal "Don't Ask, Don't Tell." One of the teens, Jeffrey Conroy, <a href="http://www.nydailynews.com/latino/2008/11/25/2008-11-25_teen_in_bias_killing_hid_knife_in_boxer_-2.html">pulled a knife out of his boxer shorts</a> and stabbed Marcelo in the chest, leaving him bleeding on the street to die.  The tragic death was the result of “<a href="http://www.huffingtonpost.com/tom-watson/remembering-marcelo-lucer_b_347808.html">Beaner Hopping</a>”, a practice that had gone on for years in Suffolk County, New York, according to statements made by the youths.</p> <p>When the police allow high school toughs to beat up on minorities for so long there is a local term for it, likely the government has failed in its duty. Government’s first responsibility is to protect those who live under its jurisdiction. Prior complaints to the police about ethnic intimidation went unanswered or the police took the story of the White perpetrator over the Latino victim, according to allegations. That is the theory behind a 40 million dollar law suit filed against Suffolk County.</p> <p><img alt="" align="left" src="http://static.technorati.com/10/12/02/22889/long-island-teensm.jpg" /></p> <p><a href="http://www.nydailynews.com/latino/2009/01/29/2009-01-29_ny_hate_crime_suspects_face_new_charges_-2.html">Jordan Dasch</a>, one of the seven teens, said he didn't participate in "Beaner Hopping" very often.  At most, the hobby was "not more than once a week".  He and his friends knocked Latinos off of bicycles, shot them with BB guns and participated in gang beatings.  </p> <p> </p> <p> </p> <p><i><b>Seven youths arrested for "Beaner Hopping"</b></i></p> <p>On the night of Lucero's death, Conroy's pals didn't know he had used a knife until they had left the scene, a fact that limited their prison terms to seven years.</p> <p>The county insists it is innocent because many of the hate crimes against Latinos were not reported to the police. The excuse is, at best, lame. The emergency room reports alone would have told the story. Over 200 people were evicted from their homes. Levy calls them criminals and “low level terrorists”. Levy has a term for those who criticize his thinking. He calls them “politically correct Communists” and “anarchists.” His rhetoric allows young people to think beating up on immigrants is okay.  It is similar thinking to using <a href="http://immigrants2bfree.blogspot.com/2010/11/steven-segal-incredible-hulk-playgirl.html">Steven Segal</a> to form a pose chasing undocumented workers, as Sheriff Joe Arpaio has done in Arizona.</p> <p>When a community allows the <a href="http://colorlines.com/archives/2010/11/marcelo_luceros_family_files_40_million_civil_rights_lawsuit_against_police.html">wholesale discrimination</a> of others, when county officials encourage aggressive enforcement tactics against minorities, when tolerance for gays, women and the poor is forgotten, it is the community that loses. Likely, if <a href="http://www.splcenter.org/sites/default/files/downloads/splc_suffolk_report_0.pdf">prior assaults</a> had not been tolerated the high school boys would not have thought it all right to go “Beaner Hopping”. The thinking cost a hard working immigrant his life.
